These Terms and Conditions govern your use of https://flowerfarmplan.com (the "Site"), including the Seed To Stem Planner. The Site is owned and operated by Ecologic Solutions Pty Ltd (ACN 679 005 540) ("we", "us" or "our").
By using the Site or joining the waitlist, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.
Free tools, provided as they are
The tools on the Site are free. They are provided as they are, without any promise that they will be error-free, always available, or suitable for your particular situation.
Planning estimates only
The planner's dates, seed numbers, yields and income figures are estimates based on the values you enter and general growing information. Weather, soil, pests, markets and many other things affect real results. Please use your own judgement and local knowledge, and do not rely on the tool output. The tool does not provide professional, financial or legal advice.
Your plans and data
Plans you make in the Seed To Stem Planner are stored in your own browser. You are responsible for keeping a copy. Clearing your browser data will delete them. How your email address and other details are handled is set out in the Privacy Policy.
Emails
If you join the waitlist, you agree to receive emails about Flower Farm Plan, including news of the Seed To Stem release and occasional updates. You can unsubscribe at any time using the link in any email.
Intellectual property
All content published and made available on the Site is the property of Ecologic Solutions Pty Ltd and the Site's creators, unless stated otherwise. This includes, but is not limited to, images, text, logos (including the Flower Farm Plan and Seed To Stem names and logos), documents, downloadable files, software, and anything that contributes to the composition of the Site. Content owned by third parties remains theirs. You are welcome to share links to any page.
Acceptable use
As a user of the Site, you agree to use the Site legally, not to use the Site for illegal purposes, and not to:
- violate the intellectual property rights of the Site owners or any third party;
- act in any way that could be considered fraudulent;
- try to break, overload or interfere with the Site or its tools; or
- copy, resell or redistribute the tools or content.
If we believe you are using the Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to the Site. We also reserve the right to take any legal steps necessary to prevent you from accessing the Site.

Some pages link to other websites. We are not responsible for their content.
Limitation of liability
To the extent permitted by law, Ecologic Solutions Pty Ltd and our directors, officers, agents, employees, subsidiaries and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses, including legal fees, arising from your use of the Site or its tools, including crop losses or lost income.
Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Indemnity
Except where prohibited by law, by using the Site you indemnify and hold harmless Ecologic Solutions Pty Ltd and our directors, officers, agents, employees, subsidiaries and affiliates from any actions, claims, losses, damages, liabilities and expenses, including legal fees, arising out of your use of the Site or your violation of these Terms and Conditions.
Applicable law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia.
Dispute resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Ecologic Solutions Pty Ltd are unable to resolve any dispute through informal discussion, then you and Ecologic Solutions Pty Ltd agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Ecologic Solutions Pty Ltd. The costs of any mediation or arbitration will be paid by the unsuccessful party.
Notwithstanding any other provision in these Terms and Conditions, you and Ecologic Solutions Pty Ltd agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
Severability
If at any time any of the provisions set out in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal, and the rest of these Terms and Conditions will still be considered valid.
Changes
We reserve the right to update these Terms and Conditions at any time, for example to maintain compliance with the law or to reflect changes to the way we operate the Site and the way we expect users to behave on the Site. Changes will be posted on this page with a revised "last updated" date, and we may also notify waitlist subscribers by email. Continued use of the Site after any changes constitutes your acceptance of the new terms.
